
Preamble
This Privacy Policy regulates the basic principles and rules for exercising the rights of personal data subjects as visitors (users) of the website https://agfutura.com.
Furthermore, pursuant to the provisions of this Privacy Policy, Company for Computer Consulting Activities AG FUTURA TECHNOLOGIES DOOEL Skopje (“AG FUTURA”), in accordance with the Law on Personal Data Protection (“Official Gazette of the Republic of North Macedonia” No. 42/20, 294/21, and 101/25), hereby informs personal data subjects, as users of the website, about the legal basis for the use of personal data, the manner of use of their personal data, the purpose of storage and processing of personal data, the scope of use of personal data, as well as other rights related to the protection of personal data in accordance with the Law on Personal Data Protection (LPDP).
AG FUTURA collects personal data exclusively from the data subjects themselves.
Users of the AG FUTURA website are advised to carefully read this document in order to become familiar with the manner in which their personal data is collected and processed.
The definitions established in this Privacy Policy are in accordance with the applicable legislation on personal data protection in the Republic of North Macedonia.
Definitions
- User. “User” is defined as a person who has submitted a message via the electronic forms on the company’s website. The term “User” also refers to all individuals who wish to obtain additional information about the company through the Website and the constituent sites of the AG FUTURA Website;
- AG FUTURA. In these Privacy Policies, “AG FUTURA” denotes the Company for Computer Consulting Activities AG FUTURA TECHNOLOGIES DOOEL Skopje, registered under the jurisdiction of the Republic of North Macedonia;
- Website. For the purposes of this Privacy Policy, “Website” refers to the following website – https://agfutura.com and all landing pages associated with this domain;
- Third Party. “Third Party” means a natural or legal person, public authority, agency, or body other than the data subject, the controller, the processor, and persons who, under the direct authority of the controller or processor, are authorized to process personal data;
- Contact Form. “Contact Form” refers to the form displayed on the AG FUTURA website that a User must complete and submit in order to obtain our services or information;
- Personal Data. “Personal Data” means any information relating to an identified or identifiable natural person (“data subject”), directly or indirectly, by reference to an identifier such as a name, identification number, location data, online identifier, or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that person. For the purposes of these Privacy Policies, the term “Personal Data” shall also apply to legal entities;
- Processing. “Processing” means any operation or set of operations performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction;
- Controller. “Controller” means a natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data, where such purposes and means are determined by the laws of the Republic of North Macedonia and the General Data Protection Regulation (“GDPR”);
- Processor. “Processor” means a natural or legal person, public authority, agency, or other body which processes personal data on behalf of the controller;
- Consent. “Consent” of the data subject means any freely given, specific, informed, and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her;
- Personal Data Breach. “Personal Data Breach” means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to personal data transmitted, stored, or otherwise processed;
- Supervisory Authority. “Supervisory Authority” means the independent public authority established by the Government of the Republic of North Macedonia or where there is a member-representative of the European Union or a third country that provides an adequate level of protection of the rights of data subjects with regard to personal data.
Categories of Data Processed
Personal Data:
- First name;
- Last name;
- Email address;
- Phone number.
User Device Data or Data Subject Processing Data (non-personal and non-identifiable):
- Internet Protocol (IP) address;
- Device used for access, type and model;
- Operating system;
- Browser type, plugins, and version;
- Pages visited on our website and time spent on each page;
- URL of the page that referred you to our website and, in some cases, the search terms used to find the AG FUTURA website;
- Browser language;
- Country (determined via IP address);
- Server logs are automatically deleted within 15 days, unless circumstances require longer retention, for example, to investigate a virus or malicious attack.
Use of the Website by Minors
We recommend that all parents and guardians educate their children about safe and responsible handling of personal data online. Minors must not provide personal data without the permission of their parents or guardians. In the event of personal data processing, if the user is 17 years old and still a minor, AG FUTURA assumes that consent has been obtained from the user’s parents. AG FUTURA does not collect or process personal data of applicants under the age of 17, nor does it disclose such data to third parties without parental/guardian consent.
Purposes of Personal Data Processing
Personal data and other information specific to the User, described in more detail under the Consent section of these Privacy Policies, will be used for specific purposes such as providing services that include informal education, scheduling informational meetings, sales and marketing activities, including email campaigns, and informing interested individuals. Users also consent to receiving a monthly newsletter from AG FUTURA and being subject to marketing campaigns.
Personal data and other information shall be used by AG FUTURA exclusively for the following purposes and shall not be used without the consent of the data subject:
Primary Processing Purposes:
- Screening or selection in the process of choosing or purchasing a service offered by AG FUTURA or other additional informational services;
Secondary Processing Purposes:
- Improving the experience and information provided by the AG FUTURA website;
- Direct marketing;
- Promotion of new products and services;
- Analysis and research activities;
- Personalized advertising and marketing communication;
- Improvement of the quality of existing products and services;
- Fulfillment of technical requirements for providing our products and services, algorithm testing, and improvement of user experience.
Consent
The User agrees that by providing the following information on the Website, i.e., by entering their email address, first and last name, and phone number via the contact form, they knowingly give consent to AG FUTURA to process their personal data for the above-stated processing purposes.
Withdrawal of Consent
The User may withdraw their consent at any time and for any reason. The withdrawal of consent and all related ramifications shall be addressed by the User to the contact specified in the Contact section of this Privacy Policy.
Notification of Personal Data Breach
In the event of a personal data breach, AG FUTURA, as the Controller, shall without undue delay and no later than 72 hours after becoming aware of the breach, notify the Supervisory Authority, unless the breach is unlikely to result in a risk to the rights and freedoms of the User. Where notification to the competent authority is not made within 72 hours, it shall be accompanied by reasons for the delay.
Where the personal data breach is likely to result in a high risk to the rights and freedoms of the User, the Controller, i.e., AG FUTURA, shall communicate the personal data breach to the data subject without undue delay. Such communication shall describe the nature of the breach in clear and plain language and shall include:
- The name and contact details of the data protection officer or another contact point;
- The likely consequences of the personal data breach;
- The measures taken or proposed to be taken by AG FUTURA to address the breach, including, where appropriate, measures to mitigate its possible adverse effects.
Request for Confirmation of Violated Personal Data Protection Rights
If the User believes that their personal data protection rights have been violated, they may submit a request at the following link: https://azlp.mk/en/ in accordance with Article 97 of the Law on Personal Data Protection.
Right of Access
The User has the right to obtain confirmation from AG FUTURA as to whether personal data concerning the User are being processed, the reasons for processing, the categories of data processed, the entities processing the data, the retention period, or, where not possible, the criteria used to determine that period, the existence of the right to rectification or erasure, the right to lodge a complaint with a competent authority, the source of the data, including profiling.
Additionally, the User shall be provided with a copy of their personal data in electronic format, free of charge.
In accordance with the Law on Personal Data Protection, data subjects may at any time request confirmation from AG FUTURA as to whether their personal data is being processed and, if so, access to the personal data and the following information:
- Processing purposes;
- Categories of personal data processed;
- Intended data retention period;
- Right to request rectification or erasure or restriction of processing;
- Right to lodge a complaint with the Agency;
- If personal data were not collected from the data subject, information on the source of the data.
Right to Rectification
Users have the right to request and obtain, within 15 days of submitting a request, rectification of inaccurate personal data. Taking into account the purposes of processing, the data subject has the right to complete incomplete personal data by providing a supplementary statement.
Right to Erasure
Users have the right to have their personal data erased by AG FUTURA without undue delay. AG FUTURA is entitled to erase personal data where one of the following applies:
- The personal data are no longer necessary for the purposes for which they were collected or processed;
- The data subject withdraws consent on which the processing is based;
- The personal data must be erased to comply with a legal obligation.
Right to Restriction of Processing
Users have the right to request restriction of processing of their personal data where one of the following applies:
- The accuracy of the personal data is contested by the data subject, for a period enabling verification;
- The processing is unlawful and the User opposes erasure and requests restriction instead;
- AG FUTURA no longer needs the personal data, but the data subject requires it for the establishment, exercise, or defense of legal claims.
Security
AG FUTURA protects users’ personal data by applying high technical, physical, and administrative security measures to minimize the risk of loss, misuse, unauthorized access, disclosure, or alteration. Protective measures include high levels of access control, use of third-party security products, and AG FUTURA’s internal data protection policies and tools. Sharing of Personal Data
AG FUTURA undertakes not to share personal data with third parties.
Notwithstanding the above, AG FUTURA may share data with competent governmental authorities where legally required.
Data Retention
Personal data is stored on third-party platforms used for customer and information management, protected by access credentials in accordance with their security standards. Access to this database is not public and is exclusively available to AG FUTURA.
Cookies and Use of Third-Party Products
The User agrees that the use of cookies is necessary for AG FUTURA to provide services related to authentication, security, advertising, performance, analytics, and research.
AG FUTURA states that Google Analytics is integrated into the Website to measure usage and generate internal reports. Google Analytics does not collect personal or identifiable user information.
Amendments to the Privacy Policy
This Privacy Policy may be amended, and updates will always be available on the AG FUTURA Website, with the date of the latest revision indicated at the bottom. Users are encouraged to stay informed about changes related to the use of personal data.
In the event of conflict between this Policy and the Law on Personal Data Protection, the provisions of the Law shall prevail.
